The final rule related to
Adult Protective Services Functions and Grants Programs was published in the Federal Register on Wednesday, May 8, 2024. It is effective June 7, 2024, and creates the first mandatory federal standards to govern Adult Protective Services (APS) policies, procedures, and practices. Each state must comply with this final rule by May 8, 2028, to receive Federal Funding, including Elder Justice Act funding for APS systems and programs.
The impact of this rule may vary by state. This rule requires the state to coordinate with the State Medicaid office, State licensing and certification agencies, and other investigative entities when there are concerns/allegations of adult maltreatment, exploitation, or abuse. The rule requires the state to define the settings and locations in which adults may experience adult maltreatment and self-neglect to be eligible for APS in the state. In the policy, states must create a definition to standardize the setting the state chooses, or is required by law, to investigate allegations of adult maltreatment or neglect.
Each state must establish policies and procedures, consistent with state law, to ensure coordination and to detect, prevent, address, and remedy adult maltreatment and self-neglect with other appropriate entities.
